The article by our colleague, Tibor Kiss examines firstly the decision of the Curia (the Supreme Court of Hungary) of April 2, 2024, which fundamentally shaped subsequent judicial practice and legislation regarding the enforcement of attorney's fees in litigation.
Then, it analyses BH 2025.112, which is closely linked to the previous decision and addressed the Supreme Court's stance on transferring litigation costs charged in foreign currency to the losing party. The Curia's ruling clarified whether the opposing party is liable for such payments. This decision impacts not only civil procedural law concerning legal costs but also civil substantive law (tort law) and public law. The paper critiques this decision as a precedent-setting one and explores the divergent jurisprudence that led to its adoption.
